DMCA Notice & Takedown Policy

Copyright handling at Porn Games.

Porn Games takes the ownership rights of creators seriously and asks everyone who uses the site to do the same. Under the Digital Millennium Copyright Act of 1998 (the "DMCA"), any properly made report of infringement sent to the copyright agent named further down gets acted on without delay.

The actual media files sit elsewhere: Porn Games keeps none of them, and what you see is linked or embedded from outside platforms. Where a link or embed turns out to infringe, we cut off access to it and, when it makes sense, pass the complaint along to whoever is hosting the file.

Filing a complaint

Own a copyright, or speak for someone who does, and reckon something on Porn Games crosses the line? Send a written notice to our agent. For it to hold up, it needs to carry more or less all of the points below:

1. The handwritten or digital signature of whoever is cleared to act for the holder of the right said to be infringed.
2. A pointer to the protected work you say has been copied, or, where one notice spans several works, a list that stands in for the whole set.
3. Enough about the offending material, and where it sits, for us to find it quickly, with the complete URL of the page it shows up on being the easiest route.
4. A way to reach you, meaning at the least your name, a mailing address, a telephone number and an email.
5. A line stating you honestly believe the use you are flagging has no green light from the owner, the owner's agent or the law.
6. A line, given under penalty of perjury, that your notice is accurate and that you are cleared to act for the owner of the right you say was infringed.

Bear in mind that Section 512(f) of the DMCA lets anyone who knowingly misstates that material is infringing be held to account for the damage that follows.

Answering with a counter-notice

Think your material came down, or got switched off, through a mistake or a mix-up? You can write a counter-notice to the same agent. It too has to carry close to all of the following:

1. Your handwritten or digital signature.
2. A note of what was pulled or blocked, plus the URL or other spot where it sat before it went.
3. A statement, sworn under penalty of perjury, that your honest belief is the takedown came about through error or misidentification.
4. Your name, mailing address and telephone number, along with your agreement to the authority of the federal district court covering where you live, or, if you are outside the United States, any federal district where the service provider can be reached, and your agreement to accept service of process from the party behind the first complaint.

Once a sound counter-notice reaches us, we may put the material back unless the side that complained first takes the matter to court against the responsible party inside ten business days of the day we received it.

Dealing with repeat offenders

It is the standing policy of Porn Games to shut off, where the situation calls for it, the accounts or site access of anyone shown to infringe over and over. We keep the right, entirely at our own discretion, to pull or disable any material said to infringe and to take whatever further steps we judge fitting.
